Terms of Service

1. Acceptance of Terms

By accessing or using CreatorMarket ("the Platform"), operated by Synexo Data Technology L.L.C, a limited liability company registered in the United Arab Emirates, you agree to be bound by these Terms of Service ("Terms"), our Privacy Policy, and any additional guidelines posted on the Platform. If you do not agree to these Terms, you must not access or use the Platform.

2. Definitions

• "Platform" — The CreatorMarket website, applications, and related services accessible at creatormarket.ae.
• "User" — Any individual or entity that creates an account or uses the Platform.
• "Creator" — A User who registers as a content creator to offer influencer marketing services.
• "Brand" — A User who registers as a brand or business to discover and engage Creators.
• "Content" — Any text, images, videos, or other material uploaded to or created through the Platform.
• "Services" — Influencer marketing services offered by Creators, including but not limited to sponsored posts, stories, reels, and other content formats.

3. Eligibility

To use the Platform, you must:

• Be at least 18 years of age
• Have the legal capacity to enter into a binding agreement
• Not have been previously suspended or removed from the Platform
• Comply with all applicable laws in your jurisdiction

If you are using the Platform on behalf of a company or organization, you represent that you have the authority to bind that entity to these Terms.

4. User Accounts

• You must provide accurate and complete information when creating an account.
• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activities that occur under your account.
• You must notify us immediately of any unauthorized use of your account.
• Each individual or entity may maintain only one account per role (Creator or Brand).

We reserve the right to suspend or delete accounts that contain inaccurate information or violate these Terms.

5. Description of Service

CreatorMarket is an online marketplace that connects Brands with content Creators in the UAE and the wider Middle East region. The Platform enables:

• Creators to list their services with transparent, fixed pricing in AED
• Brands to discover, evaluate, and contact Creators based on audience data and service offerings
• Direct communication between Brands and Creators through the Platform's messaging system
• Creators to showcase verified social media metrics and audience demographics

6. Role of the Platform

CreatorMarket is a marketplace that facilitates connections between Brands and Creators. We are not a party to any agreement, transaction, or collaboration between Users. We do not employ, manage, or control Creators, nor do we guarantee the quality, timing, or delivery of any Services.

7. User Conduct

All Users agree not to:

• Provide false, misleading, or inaccurate information in profiles, listings, or communications
• Impersonate any person, entity, or falsely represent an affiliation
• Harass, abuse, threaten, or discriminate against other Users
• Post spam, unsolicited advertisements, or promotional content outside designated areas
• Attempt to gain unauthorized access to the Platform, other accounts, or our systems
• Use the Platform for any illegal, fraudulent, or harmful purpose
• Scrape, crawl, or use automated means to extract data from the Platform
• Circumvent the Platform to avoid fees or to conduct transactions off-platform after initial contact
• Upload malicious code, viruses, or any material that could harm the Platform or its Users

8. Creator Responsibilities

As a Creator, you agree to:

• Accurately represent your services, capabilities, pricing, and audience metrics
• Deliver agreed-upon content within agreed timelines and to a professional standard
• Maintain professional and respectful communication with Brands
• Disclose sponsored content in accordance with applicable UAE advertising regulations and platform guidelines
• Not artificially inflate follower counts, engagement metrics, or audience demographics
• Ensure that all content you create complies with applicable laws and does not infringe third-party rights

9. Brand Responsibilities

As a Brand, you agree to:

• Clearly communicate campaign requirements, expectations, and deliverables
• Make timely payments as agreed with Creators
• Treat Creators with respect and professionalism
• Provide accurate information about your company and campaigns
• Not request content that violates applicable laws, regulations, or third-party rights
• Obtain necessary rights and permissions before using Creator content beyond the agreed scope

10. Payments

All payments for Creator services are currently handled directly between Brands and Creators outside the Platform. CreatorMarket does not process, hold, or mediate payments between Users.

• CreatorMarket is not responsible for payment disputes between Users
• We strongly recommend using secure payment methods and maintaining written agreements
• Creators set their own prices; CreatorMarket does not control or endorse pricing
• All prices displayed on the Platform are in UAE Dirhams (AED)

11. Content & Intellectual Property

Your Content

You retain ownership of all Content you upload to the Platform (profile information, images, portfolio items, campaign descriptions). By uploading Content, you grant CreatorMarket a non-exclusive, worldwide, royalty-free license to display, distribute, and reproduce your Content solely for the purpose of operating and promoting the Platform.

Creator Work Product

Content created by Creators as part of a collaboration with a Brand remains the Creator's intellectual property unless otherwise agreed in writing between the Creator and Brand. Brands should negotiate usage rights, exclusivity, and licensing as part of their agreements with Creators.

Platform Intellectual Property

The CreatorMarket name, logo, design, and all software, features, and technology powering the Platform are the property of Synexo Data Technology L.L.C and are protected by applicable intellectual property laws. You may not copy, modify, or distribute any part of the Platform without our prior written consent.

12. Social Media Integrations

CreatorMarket allows Creators to connect supported social media properties via OAuth authorization, including Instagram professional accounts and Facebook Pages. By connecting a supported account or page, you:

• Authorize Data Access — You grant CreatorMarket permission to access supported profile, page, audience, and engagement metrics through the respective platform's API.
• Accept Data Accuracy — While we strive to display accurate data, metrics such as follower counts, page counts, audience insights, and engagement rates are sourced from third-party APIs and may not always reflect real-time values.
• Can Disconnect Anytime — You may disconnect a connected social media account or page at any time through your dashboard settings, which removes the stored authorization and imported metrics associated with that connection.
• Comply with Platform Terms — You agree that your use of connected social media features complies with the respective platform's terms of service.

We store access tokens in encrypted form (AES-256-GCM) and never share them with third parties. For more details, see our Privacy Policy.

13. Fees

Creating an account and browsing the Platform is currently free. CreatorMarket reserves the right to introduce fees, subscriptions, or commission-based pricing in the future. Any such changes will be communicated to Users in advance, and continued use of the Platform after the introduction of fees constitutes acceptance.

14. Termination

You may delete your account at any time through your dashboard settings. Upon deletion, your profile and associated data will be removed in accordance with our Privacy Policy.

We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent or harmful behavior, or remain inactive for an extended period. We will provide notice where reasonably possible.

15. Disclaimers

The Platform is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that:

• The Platform will be uninterrupted, error-free, or secure
• The information provided by Users (including audience metrics) is accurate or complete
• Any particular outcome will result from using the Platform
• The Platform will meet your specific requirements

16. Limitation of Liability

To the maximum extent permitted by applicable law, Synexo Data Technology L.L.C and its officers, directors, employees, and agents shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages
• Any loss of profits, revenue, data, or business opportunities
• Disputes between Users, including payment disputes or quality of delivered content
• Actions or omissions of third-party services (including social media platforms)
• Unauthorized access to or alteration of your data

Our total liability for any claim arising from or related to these Terms or the Platform shall not exceed the amount you have paid to CreatorMarket in the twelve (12) months preceding the claim, or AED 500, whichever is greater.

17. Indemnification

You agree to indemnify, defend, and hold harmless Synexo Data Technology L.L.C, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your use of the Platform, Content you upload or distribute, your interactions with other Users, or your violation of these Terms or any applicable law.

18. Privacy

Your use of the Platform is also governed by our Privacy Policy, which describes how we collect, use, store, and protect your personal information. By using the Platform, you consent to the practices described in the Privacy Policy.

19. Changes to Terms

We may update these Terms from time to time. When we make material changes, we will notify you by updating the "Last updated" date and, where appropriate, by email or through a notice on the Platform. Continued use of the Platform after changes take effect constitutes your acceptance of the revised Terms.

20. Governing Law & Disputes

These Terms are governed by and construed in accordance with the laws of the United Arab Emirates. Any disputes arising from or related to these Terms or the Platform shall be subject to the exclusive jurisdiction of the courts of Dubai, United Arab Emirates.

Before initiating legal proceedings, both parties agree to attempt to resolve disputes through good-faith negotiation for a period of at least thirty (30) days.

21. General Provisions

Severability. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

Entire Agreement. These Terms, together with the Privacy Policy, constitute the entire agreement between you and Synexo Data Technology L.L.C regarding the use of the Platform.

No Waiver. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

Assignment. You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights and obligations without restriction.

Force Majeure. We shall not be liable for any delay or failure to perform our obligations due to circumstances beyond our reasonable control, including natural disasters, war, pandemics, government actions, or infrastructure failures.
